General terms and conditions for sweepstakes

I. SCOPE

1.1

This competition is run by HABA – a brand of HABA Sales GmbH & Co. KG (HABA), August-Grosch-Straße 28-38, 96476 Bad Rodach. These terms and conditions shall apply in addition to any special terms and conditions, if and insofar as such have been announced for the respective competition.

1.2

By entering, each participant accepts these terms and conditions as well as the participation deadline and conditions specified separately for each competition.

II. PARTICIPATION

2.1

Any natural person of full age (18 years) resident in Germany, Austria or Switzerland may participate.

2.2

Employees of the HABA FAMILYGROUP and any cooperation partners, as well as their relatives, are excluded from participation.

2.3

Each participant may enter only on their own behalf and only once per competition. Multiple entries do not increase the chance of winning. Any prizes are non-transferable.

2.4

The deadline for entries is the end of the participation period.

III. PRIZE AND CONDUCT

3.1

Winners will be determined by HABA, its employees, vicarious agents or commissioned third parties by means of a technical random process, a jury or by drawing lots on site. Legal recourse is excluded.

3.2

A maximum of one winner per household and participant will be drawn. Determined winners will be notified in writing by e-mail or post.

3.3

If the prize cannot be accepted by the winner or the winner does not respond to the prize notification within 3 months, the prize will lapse without replacement. In this case, HABA is entitled to select a new winner from the pool of eligible participants. The same applies if a winner provides incorrect contact details to HABA and dispatch or handover of the prize is therefore not possible.

3.4

Any prize shown pictorially in the competition description is not necessarily identical to the item to be won. Variations, in particular in model, colour and equipment, etc., are possible. HABA reserves the right to replace prizes with other prizes of a similar value if the specified prize is no longer available for reasons beyond HABA's control.

3.5

Postage costs for shipping the prize abroad are, in case of doubt, not included. Any (consequential) costs incurred by the winner in connection with and/or through the use of the prize are only covered if this is expressly stated in the competition. HABA assumes no liability for damage suffered by a participant or third parties as a result of accepting and/or using the prize, except in cases of intent or gross negligence.

3.6

A cash payment or a credit note equivalent to the prize value, or any claim in respect of the prize, is not possible. The prize is neither transferable nor exchangeable.

IV. EARLY TERMINATION, EXCLUSION

4.1

HABA is entitled to exclude participants from this competition who breach the terms and conditions, provide incorrect personal details, use unfair means or attempt to manipulate the result of the draw.

4.2

If there is a ground for exclusion, HABA is – even retrospectively – entitled to revoke prizes and to reclaim prizes already handed over.

V. LIABILITY

5.1

HABA shall be released from all obligations upon delivery of the prize. No liability is accepted for legal and/or material defects, including travel defects, in the described prize. Any warranty claims by the winners are hereby expressly excluded.

5.2

HABA is not liable for damage that may arise from errors, delays or interruptions in data transmission, malfunctions of technical systems and services, incorrect content, loss or deletion of data, viruses or otherwise in connection with participation. This applies in particular to lost, damaged, incorrectly transmitted or delayed entries, prize notifications and other problems of electronic communication, as well as to other technical difficulties in the competition.

5.3

Where participants upload images / posts / comments, the participant warrants that they will not submit any content whose provision, publication or use infringes applicable law or the rights of third parties. Should participants infringe third‑party rights or the transmitted content be unlawful for other reasons, the participant shall indemnify us against any third‑party claims of whatever nature arising from such illegality.

VI. DATA PROTECTION

6.1

HABA respects the privacy of participants and is committed to data protection. HABA is the controller within the meaning of Art. 4(7) GDPR.

When participating online, providing an e‑mail address is essential for notifying winners. You will receive newsletters only if you have expressly consented to them. Some competitions require the provision of additional personal data in order to realise the nature of the competition or these data may be provided voluntarily. To be able to send you your prize, the following personal data will also be collected: first name, last name, address.

By entering this competition, each participant consents to the processing of their personal data for the purposes of conducting and administering the competition in accordance with Art. 6(1)(a) and (b) GDPR.

Where the processing of personal data is based on consent, the participant may withdraw that consent at any time, without giving reasons, with effect for the future. 6.2

We use postal data for our advertising mailings by post. We enable carefully selected postal service providers, brand manufacturers, publishers and affiliated companies to send you information and offers as part of promotional communications. The legal basis for this is Art. 6(1)(f) GDPR. For third‑party marketing purposes, only those data will be passed on where this is legally permitted. If you no longer wish to receive information and offers in future, you may at any time object to the use of your data for advertising purposes by means of an informal notification object. 6.3

The participant agrees that their name and place of residence may be published on HABA's website www.haba.de after the draw. The surname will be shown only by its initial letters. If you hold copyright or other rights in the image, you grant HABA a simple, free, unlimited right of use territorially, in content and in time to publish the image on HABA's website and in the communication channels named in the special terms and conditions of the competition (e.g. Instagram, Facebook).

6.4

The data stored with us will be deleted as soon as they are no longer required for their intended purpose and deletion is not opposed by any statutory retention obligations.

VII. MISCELLANEOUS

7.1

HABA is entitled to terminate the competition early or to amend the terms and conditions. This applies in particular in cases of force majeure and where proper conduct of the competition cannot be guaranteed for technical and/or legal reasons.

7.2

The law of the Federal Republic of Germany shall apply.
