General terms and conditions for sweepstakes

I. SCOPE

1.1

This contest is conducted by HABA – a brand of HABA Sales GmbH & Co. KG (HABA), August-Grosch-Straße 28-38, 96476 Bad Rodach. These terms and conditions apply, where applicable, in addition to any special terms and conditions that were announced for the respective contest.

1.2

By participating, each participant acknowledges these terms and conditions as well as the participation period and conditions stated separately for each contest.

II. PARTICIPATION

2.1

Any adult (18 years or older) natural person residing in Germany, Austria or Switzerland may participate.

2.2

Employees of the HABA FAMILYGROUP and any cooperation partners, as well as their relatives, are excluded from participation.

2.3

Each participant can only participate in their own name and only once per contest. Multiple entries do not increase their chances of winning. Any prizes are non-transferable.

2.4

The deadline for entries is the end of the participation period.

III. PRIZE AND CONDUCT

3.1

The selection of winners is carried out by HABA, its employees, vicarious agents or commissioned third parties by a technical random process, a jury, or an on-site draw. Legal recourse is excluded.

3.2

A maximum of one winner will be drawn per household and participant. Determined winners will be notified in writing by e-mail or post.

3.3

If the prize cannot be claimed by the winner or the winner does not respond to the prize notification within 3 months, the prize will lapse without replacement. In this case HABA is entitled to select a new winner from among the participants eligible to win. The same applies if a winner provides HABA with incorrect contact details and the sending or handover of the prize is therefore not possible.

3.4

The prize possibly shown pictorially in the contest description is not necessarily identical to the item to be won. Deviations, in particular in model, color and equipment, etc., are possible. HABA reserves the right to replace the prizes with other prizes of similar value if the stated prize is no longer available for reasons outside HABA's control.

3.5

Postal costs for shipping the prize abroad are, in case of doubt, not included. Any (consequential) costs incurred by the winner during and/or through the use of the prize are only included if this was expressly stated in the contest. HABA assumes no liability for damages suffered by a participant or third parties through acceptance and/or use of the prize, except in cases of intent or gross negligence.

3.6

Cash payment or credit equal to the prize value is not possible. The prize is neither transferable nor exchangeable.

IV. EARLY TERMINATION, EXCLUSION

4.1

HABA is entitled to exclude participants from this contest who violate the terms and conditions, provide incorrect personal information, use unfair aids or attempt to manipulate the draw result.

4.2

If there is a reason for exclusion, HABA is entitled — also retrospectively — to revoke prizes and to reclaim prizes already handed over.

V. LIABILITY

5.1

HABA is released from all obligations upon delivery of the prize. No liability is assumed for legal and/or material defects, including travel defects, in the described prize. Any warranty claims of the winners are hereby expressly excluded.

5.2

HABA is not liable for damages that may arise from errors, delays or interruptions in data transmission, malfunctions of technical systems and services, incorrect content, loss or deletion of data, viruses or otherwise in connection with participation. This applies in particular to lost, damaged, incorrectly transmitted or late registrations, prize notifications and other problems of electronic communication, as well as other technical difficulties of the contest.

5.3

If the participant uploads images / posts / comments, the participant guarantees that they will not submit any content whose provision, publication or use violates applicable law or third-party rights. If participants infringe third-party rights or the transmitted content is unlawful for other reasons, the participant indemnifies us against any claims by third parties of any kind arising from the unlawfulness.

VI. DATA PROTECTION

6.1

HABA respects the privacy of participants and is committed to data protection. HABA is the controller within the meaning of Art. 4(7) GDPR.

When participating via the Internet, providing an e-mail address is indispensable for notifying the winners. You will only receive newsletters if you have expressly consented to this. Some contests require the provision of further personal data in order to carry out the type of contest or constitute voluntary information. In order to send you your prize, the following personal data will additionally be collected: first name, last name, address.

By participating in this contest and its implementation and processing, each participant consents to the processing of their personal data in accordance with Art. 6(1)(a), (b) GDPR.

If the processing of personal data is based on consent, the participant may revoke it at any time, without giving reasons, with effect for the future. 6.2

We use postal data for our advertising by post. We enable carefully selected shipping companies, brand manufacturers, publishers and affiliated companies to send you information and offers as part of advertising communications. The legal basis for this is Art. 6(1)(f) GDPR. For third-party marketing purposes, only those data will be disclosed for which this is legally permitted. If you no longer wish to receive information and offers in the future, you can at any time object to the use of your data for advertising purposes by means of an informal notification object. 6.3

The participant agrees that their name and place of residence will be stated on HABA's website www.haba.de after the draw. The surname will be given only by its initial(s). If you hold copyright or other rights to the image, you grant HABA a geographically, materially and temporally unrestricted, free, non-exclusive right of use to publish the image on HABA's website as well as in the communication channels named in the special terms and conditions of the contest (e.g. Instagram, Facebook).

6.4

The data stored with us will be deleted as soon as they are no longer required for their intended purpose and there are no statutory retention obligations preventing deletion.

VII. MISCELLANEOUS

7.1

HABA is entitled to terminate the contest prematurely or to amend the terms and conditions. This applies in particular in cases of force majeure and if proper conduct of the contest cannot be guaranteed for technical and/or legal reasons.

7.2

The law of the Federal Republic of Germany shall apply.
